Full Terms & Conditions
1. Booking and deposit
– A £35 booking deposit applies to sessions booked with vouchers. Sessions purchased directly from the studio (by buying a session fee) do not require a booking deposit.
– Voucher bookings are confirmed when we receive the deposit and send a booking confirmation.
2. Deposit refund and viewing requirement
– For voucher bookings: the £35 deposit is refundable only if you book and attend your in-studio viewing appointment within 90 days of the session. If you do not attend the viewing within 90 days, the deposit will be forfeited.
3. Rescheduling and cancellations
– One free reschedule: Voucher bookings may be rescheduled once without forfeiting the deposit provided the request is made in writing at least 14 days before the original session date. The deposit will be held and applied to the new date.
– Late reschedule / cancellation / no-show: If you cancel, fail to attend, or request a reschedule with less than 14 days’ notice, the £35 deposit will be forfeited. After forfeiture, a new £35 deposit is required to secure any replacement date.
– All reschedules are subject to studio availability. Any rescheduled viewing must still be attended within 90 days of the original session to preserve the refund condition.
4. Studio cancellations and force majeure
– If Dumbletons Studio must cancel your session (for example due to illness, equipment failure, or other unforeseen events), we will offer an alternative date. If no suitable date can be agreed, any deposit paid will be refunded in full.
– The photographer is not liable for failure to perform where such failure is caused by events beyond reasonable control (fire, flood, severe weather, pandemics, travel restrictions, etc.). We will attempt to reschedule and/or refund as appropriate.
5. Viewing appointments and image selection
– All image viewing and selection take place in-studio only. We do not provide online galleries, remote viewing, or separate proofs.
– You must book and attend your in-studio viewing appointment no later than 90 days after the session. If you do not book and attend within 90 days, the studio may archive or permanently delete your images and any applicable voucher deposit will be forfeited.
6. Session attendance, late arrivals and missed sessions
– Sessions run for the agreed duration. If you arrive late, your session time may be reduced so the next booking is not affected. Additional time may be available at an extra fee.
– Failure to attend a session or viewing appointment without prior written agreement will be treated as a cancellation and any voucher deposit will be retained.
7. Mobile phones, photography and recording
– Personal mobile photography and recording by clients or guests during sessions and viewings is prohibited to protect the studio environment and image quality.
8. Proofs, retouching and delivery
– Proofs are not provided via online galleries. In-studio viewing appointments are used to preview and select images.
– Final edited images and products will be delivered within 4 weeks after image selection and receipt of full payment, unless otherwise stated.
– The number of included retouched images is as specified in your booking. Additional retouching is available at extra cost.
9. Payment and final balance
– The remaining balance for sessions, prints, and products is due as stated at booking or before delivery/collection. Accepted payment methods: card (Visa/Mastercard), bank transfer, and cash.
– Prints and products will be supplied after full payment. Production times apply.
10. Copyright and image use
– Copyright of all photographs remains with Dumbletons Studio/the photographer.
– Purchasing prints does not transfer copyright and does not grant the purchaser the right to copy, duplicate, scan, reproduce, or upload the prints or images online. Prints are for personal display only and must not be digitally reproduced in ways that create high-quality duplicates.
– Purchasing digital images grants the purchaser a non-exclusive, unlimited personal-use licence for those digital files. “Unlimited personal use” permits printing for personal display and sharing on personal social media accounts. Commercial use (advertising, resale, endorsement, promotion for financial gain) requires a separate commercial licence and fee – contact the studio for details.
– Clients must not remove, alter, or obscure any copyright notices or watermarks applied to proofs or files supplied prior to final purchase.
11. Promotional and portfolio use
– Dumbletons Studio will not use your photographs for promotional, portfolio, website, social media, or advertising purposes unless you have provided explicit written consent. If you grant permission for promotional use, we will request a written agreement specifying which images may be used and for which purposes.
12. Newborn and child safety
– The safety of babies and children is paramount. The photographer will not attempt or allow unsafe posing. Parents/guardians must follow the photographer’s instructions. If a baby or child is unwell on the day of the session, please contact us to reschedule.
– The studio reserves the right to stop or modify any pose deemed unsafe.
13. Liability
– The studio is not responsible for loss, damage, or theft of personal items belonging to clients or guests.
– Dumbletons Studio’s liability for any claim arising directly from services provided is limited to the amount paid for the session.
14. Products, faults and refunds
– All prints and products are inspected before dispatch. If a product is faulty, notify us within 14 days of receipt and we will repair or replace it where possible.
– Refunds are only available for faulty products and will be handled in accordance with UK consumer law. Non-faulty product dissatisfaction is not grounds for refund.
15. Data protection and image storage (GDPR)
– We collect and process personal data (name, contact details, booking details, images) to provide our services. We will only use your data for legitimate business purposes related to your booking unless you give additional consent.
– Images are stored for 90 days from the date of the session to allow for in-studio viewing, selection, re-orders and backup. After 90 days, images may be permanently deleted to free studio storage. Dumbletons Studio will not notify clients before deleting images.
– If you request deletion of your images before the 90-day period ends, contact us. We will consider such requests but may decline if retention is required for legal or legitimate business reasons (for example, bookkeeping or dispute resolution).
– We do not sell personal data. Any third-party sharing (printers, labs) is limited to order fulfilment and done under confidentiality where possible.
16. Complaints and disputes
– If you have a complaint, please contact us in writing and we will respond within 14 working days.
– These terms are governed by the laws of England and Wales. Any dispute will be subject to the jurisdiction of the UK courts.
17. Agreement
– By paying any required deposit you confirm you have read and agree to these Terms & Conditions, including the deposit/refund rules, the one free reschedule policy, and the 90-day in-studio viewing requirement. A record of your acceptance will be retained with your booking.
